Terms of Service

These Terms govern your access to and use of Presence AI, including the website, web app, paid plans, speech-analysis features, and related services.

By accessing or using Presence AI, you agree to these Terms. If you do not agree, do not use the service. If you use Presence AI on behalf of an organization, you represent that you have authority to bind that organization.

The service

Presence AI provides reading, vocabulary, articulation, recording, transcription, and AI-assisted speech feedback tools. The service is designed to help users practice reading aloud, improve vocabulary, and become more articulate and confident speakers.

Presence AI is not medical care, clinical speech therapy, diagnosis, disability accommodation, mental health treatment, or professional education advice. If you need clinical, educational, or therapeutic support, consult a qualified professional.

Accounts and eligibility

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 13 years old, or older if required by your local law, to use Presence AI without parental, guardian, school, or organizational authorization.

Acceptable use

You may not use Presence AI to:

• Violate law, infringe rights, or upload content you do not have the right to use.
• Record someone else without required consent.
• Upload sensitive personal information unless necessary for your use of the service and permitted by law.
• Harass, threaten, abuse, exploit, or harm others.
• Reverse engineer, scrape, overload, bypass, or interfere with the service.
• Use the service to build or train a competing product except as allowed by law.
• Attempt to evade payment, fraud controls, usage limits, or security measures.

Your content

You retain ownership of passages, recordings, transcripts, notes, prompts, and other content you submit to Presence AI. You grant Presence AI a limited license to host, process, reproduce, transmit, analyze, display, and create outputs from your content as needed to operate, secure, support, and improve the service.

You are responsible for ensuring that your content and recordings are lawful and that you have all rights and consents needed to submit and process them.

AI output and speech feedback

AI-generated transcripts, scores, pronunciation notes, vocabulary suggestions, and coaching feedback may be incomplete, inaccurate, or unsuitable for your specific needs. You should use judgment before relying on any output. Presence AI does not guarantee a specific improvement, score, educational result, or communication outcome.

Paid plans and Polar checkout

Paid plans, subscriptions, one-time purchases, checkout, payment methods, taxes, invoices, receipts, renewals, cancellations, and some billing communications may be handled by Polar. Polar may act as merchant of record for transactions completed through Polar checkout.

Purchases through Polar may also be subject to Polar’s Checkout Buyer Terms, Privacy Policy, and other applicable Polar legal terms, available at polar.sh/legal. If there is a conflict about checkout, payment processing, tax, invoice, receipt, or customer portal functionality, Polar’s applicable buyer terms may control for that transaction.

Subscriptions and cancellation

If you buy a recurring subscription, you authorize recurring charges for the subscription period shown at checkout until canceled. Unless otherwise stated at checkout, subscriptions renew automatically at the then-current price plus applicable taxes.

You may cancel through the billing flow, account billing area, Polar customer portal, or links provided in Polar transactional emails. Cancellation stops future renewal; it does not automatically refund the current paid period. You may continue using paid features until the end of the current term unless the service is terminated for violation of these Terms or required by law.

Refunds, taxes, and chargebacks

Unless stated otherwise at checkout or required by law, fees are non-refundable after purchase or renewal. Refund requests may be reviewed by Presence AI and/or Polar and may be subject to Polar’s buyer terms, risk controls, refund processes, tax handling, payment network rules, and applicable law.

Prices may exclude or include taxes depending on your location and checkout presentation. Polar may calculate, collect, remit, refund, or adjust applicable taxes where required. If you believe a charge is incorrect, contact support before initiating a chargeback so we can review the issue.

Free trials and promotional offers

We may offer trials, discounts, credits, or promotional access. Unless otherwise stated, we may modify or end promotional offers at any time. If a trial converts to a paid plan, the checkout or offer terms will explain when billing begins.

Mobile apps

Presence AI is available on the web. iOS and Android applications are planned but not guaranteed until released. References to “coming soon” features are forward-looking and may change, be delayed, or be discontinued.

Intellectual property

Presence AI, including its software, design, branding, interfaces, workflows, and non-user content, is owned by Presence AI or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership in the service.

If you send feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation.

Privacy

Our Privacy Policy explains how we collect, use, and share information. By using Presence AI, you acknowledge that we process information as described there.

Service changes and termination

We may modify, suspend, restrict, or discontinue all or part of Presence AI at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay, or used the service unlawfully or abusively.

Disclaimers

Presence AI is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.

Limitation of liability

To the maximum extent permitted by law, Presence AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid to Presence AI for the service in the three months before the event giving rise to the claim or USD $100.

Indemnity

You agree to defend, indemnify, and hold harmless Presence AI from claims, damages, liabilities, costs, and expenses arising from your content, your use of the service, your violation of these Terms, or your violation of law or third-party rights.

Governing law

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the State of Delaware, excluding conflict of law rules. Courts located in Delaware will have exclusive jurisdiction for disputes that are not subject to arbitration or small-claims procedures.

Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of Presence AI after updated Terms become effective means you accept the updated Terms.
